Use of the Fuel Price Mapping Mobile Program constitutes your acceptance of these Terms and Conditions (the "Agreement").

• WEX Inc. ("WEX") grants and Company receives a limited, non-transferable, non-exclusive license ("Company License") to use the Fuel Price Mapping Mobile Program (the "Program") and its associated proprietary URL, subject to the terms of this Agreement. Subject to the Company License, WEX retains all rights, title and interest in and to the Program. The Program is an online application designed to help provide your drivers with WEX accepting merchant information accessed through a proprietary URL provided by WEX. The Program does not promote one site over another or one brand over another.
• Results are displayed on web-enabled personal handheld devices referred to as Personal Digital Assistants ("PDA(s)"). The Program requires the user to enter location, radius and fuel type to obtain results. The results will only include those merchant locations where a WEX transaction has been authorized in the last 6 months. Price information will be displayed if a transaction has been authorized at that merchant location in the last 7 days. WEX is not permitted to include all merchant brands in its price per gallon reporting tools. WEX does not guarantee the accuracy of the price per gallon listed at each location and will only report information available. Price changes can occur at the sole discretion of the merchant.
• Due to the wide variety of PDA technology in the market, WEX cannot guarantee that the Program application will work on all devices. Company may incur additional fees or charges from their mobile carrier for accessing the application.
• Users with JavaScript enabled devices may also be able to click the accepting merchant location information displayed in the results to access GoogleTM maps with directions. The maps are powered by Google and WEX makes no representations or warranties related to the accuracy or currency of such maps. The directions provided are for planning purposes only. Construction projects, traffic, weather, or other events may cause conditions to differ from the map results, and Company should plan routes accordingly. Drivers must obey all signs or notices regarding the route.
• In the event that legislation or governmental regulations, or requirements limit or prohibit the delivery or use of this Program, or if, in our reasonable judgment, delivery or use of this Program would violate any such legislation, regulations or requirements, WEX may suspend delivery of the Program or terminate the Program without notice to you.
• You are permitted to use the Program in accordance with the Company License. The following restrictions apply: (a) The Program will not be: (i) sold, leased, rented or otherwise provided to any other third party; (ii) used for the benefit of a third party; or (iii) in the development of any products or services to be provided to a third party.
• WEX makes no warranties, express or implied, with respect to the Program products, transmission channels, or the media on which the Program is provided, including but not limited to warranties or accuracy, completeness or fitness for a particular purpose.
• There is no cost for using this Program.
